Our client, a female in her 20s, was a passenger in an Uber that got involved in a crash in Miami. It happened in the early morning hours and our client had been out with friends that night. Our position from the medical evidence was that she sustained orthopedic injuries and a traumatic brain injury (TBI).
Progressive Insurance company, which insured Uber for $1 Million, stood in the shoes of the at-fault driver. They defended the case and denied all the material claims, claiming that our client was not hurt and did not have a TBI. Through discovery, Progressive learned that our client had been skiing after the crash and continued to work.
At trial, we explained how the TBI had affected her as a friend and employee, having her best friend testify as a before/after witness. We also had board-certified experts like a neurologist and a neuroradiologist explain the exact nature of her injuries. We vigorously cross-examined the defense retained experts showing the full extent of their financial bias having made tons of money working for Progressive as experts. The jury returned a verdict of $2.5 Million.
